KGB raises the important point about clients asking for a SWMP at tender - if they do not provide a draft at tender or on appointment of a winning bidder they themselves are guilty of an offence. The mechanics of the regulations are actually straightforward
1) Client and Design Team produce a draft SWMP
2) Draft SWMP passed to winning contractor
3) Winning contractor develops final plan
4) Contractor and client commit to the plan and managing waste efficiently
5) Monitor effectiveness and suitability of plan throughout contract by both client and PC
6) Projects >£500k do post project review within 12 weeks of practical completion
Clients are however still not understanding their duties and as mentioned above a project can be non notifiable and yet caught up in the SWMP regulations.
Another point about these regulations is that all duties under waste management legislation still applies at all times and the basic SWMP actually does not include all information that is legally required under the waste legislation that exists. Beware of this point.
